Appeal Court sitting in Abuja, has upheld the election of Governor Gboyega Oyetola in the September 2018 Osun State Governorship Poll.
The Appellate Court revokes the verdict of the Osun State Governorship Poll Petition Tribunal which awarded the Poll to PDP candidate, Senator Ademola Adeleke.
Four out of the five member Appeal Court’s panel upheld Oyetola’s victory in the Poll, while one of them dissented.
The Court in the majority judgement primarily based its decision on the absence of a member of the Osun State Poll Tribunal, Justice Peter Obiora, from the February 6, 2019 proceeding in which Governor Oyetola was revoked.
According to majority judgement, the absence of Justice Obiora who read the Tribunal’s judgement, nullified the entire process and the verdict of the Tribunal of last February 6.
The dissenting member of the Appeal Court panel, Justice George Mbaba, disagrees, saying the absence of Justice Obiora from the last February 6 proceeding of the Tribunal was speculative.
